1. Acceptance of Terms
By accessing or using Asbury Edge ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Asbury Edge is an event discovery application for Asbury Park, New Jersey. We reserve the right to modify these terms at any time. Continued use of the App after changes constitutes acceptance of the updated terms.
2. Account Terms
To access certain features of the App, you may be required to create an account. When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use
You may authenticate using third-party services such as Google or Apple Sign-In. By doing so, you authorize us to access certain information from those services as described in our Privacy Policy.
Supporter Recognition for Donations: If you choose to make a donation/tip through the App, you authorize Asbury Edge to display a supporter recognition notification that may include your username. If no username is available, we may use a generic label (for example, "Someone").
Donations are voluntary and are used to support operation and maintenance of the App.
3. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Submit false, misleading, or fraudulent information
- Impersonate any person or entity
- Use automated means to access the App without permission
- Harvest or collect information about other users
4. Event Information
Event listings are curated by our team using information from venues, promoters, and community sources. Published listings are reviewed before appearing in the App.
Asbury Edge provides information about events in Asbury Park. While we strive to maintain accurate and up-to-date information:
- Event details are subject to change without notice
- We are not responsible for event cancellations, rescheduling, or venue changes
- We recommend confirming event details with organizers before attending
- Event listings do not constitute an endorsement of any event or organizer
- Some event listings may include pre-filled details, which may introduce inaccuracies
5. User-Submitted Content
The App may allow event information and flyer submissions in future releases. In the current release, this workflow is disabled in-app and event flyer uploads are not available. If and when this workflow is enabled, you agree that:
- You have the right to share the content you submit
- Submitted images may be processed to identify event details for your review
- We may edit, modify, or reject submissions at our discretion
- You grant us a non-exclusive license to display, reproduce, and distribute your submitted content within the App
- We track submission history and approval rates to maintain content quality
- Repeatedly submitting false, misleading, or inappropriate content may result in submission restrictions
If enabled, pre-filled details may produce inaccuracies. We recommend verifying event details with organizers.
6. Intellectual Property
The App, including its design, features, content, and branding, is owned by Asbury Edge and protected by intellectual property laws. You may not:
- Copy, modify, or distribute the App or its content without permission
- Use our trademarks or branding without written consent
- Reverse engineer or attempt to extract the source code
7. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Results obtained from the App will be accurate or reliable
- Any errors or defects will be corrected
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASBURY EDGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or use
- Damages resulting from reliance on event information
- Damages arising from your attendance at any event
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to use the App, if any.
9. Indemnification
You agree to indemnify and hold harmless Asbury Edge, its operators, and affiliates from any claims, damages, losses, or expenses arising from your use of the App or violation of these terms.
10. Account Deletion and Termination
Account Deletion by You: You may delete your account at any time through the App by going to Profile → Delete Account. Account deletion is immediate and permanent. All your data, including your profile, favorites, preferences, and any submission history (if present), will be permanently removed. This action cannot be undone.
Termination by Us: We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.
